Maktoum Bin Mohammed Approves Strategic Plan To Enhance Enforcement Of Civil Judgments Of Dubai Courts

His Highness Maktoum bin Mohammed bin Rashid Al Maktoum has given his approval to a strategic plan to expedite the enforcement of civil judgements of Dubai Courts.

This initiative will help improve the efficiency of judicial processes and enhance confidence in the judicial system in Dubai, which are critical factors in ensuring the emirate’s global competitiveness.

The action is a part of implementing the directives of His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE and Ruler of Dubai, who has long supported for enhancement of Dubai’s legal system.

This initiative will benefit businesses and individuals seeking justice and contribute to the emirate’s overall economic growth and development.

This dedication is in keeping with His Highness Sheikh Mohammed bin Rashid’s objective to make Dubai one of the best cities in the world and create the most effective judicial system ever.

The strategic plan comprises creative activities made to satisfy residents’ requirements and create the perfect setting for putting laws and regulations into effect.

This indicates a forward-thinking strategy for improving Dubai’s justice system and adjusting to the shifting requirements of its diverse population.

By putting this strategic plan into action, Dubai is making an important contribution to the enhancement of its legal system and its position as a major international hub for trade and investment. 

His Excellency Taresh Eid Al Mansouri, Director General of the Dubai Courts, is committed to speeding up the execution of judgements, eliminating issues that can impair the effectiveness of judicial services, and reforming procedures for enforcing court rulings. These initiatives will contribute to the development of an advanced judicial system in Dubai that meets international standards for effectiveness, timeliness, and customer service.

The strategic plan includes a number of creative initiatives that meet the requirements of both citizens and residents while promoting an environment that is conducive to the enforcement of laws and regulations.

Writ of Execution Seal: The Writ of Execution Seal initiative seeks to simplify and expedite the process of enforcing court judgements through an electronic seal that will act as an official authorization for the execution of the judgement. 

In the past, physical documentation and manual verification of the documents were necessary for the enforcement of court judgements. However, the procedure can be improved, making it quicker, more precise, and more effective with the introduction of an electronic Writ of Execution seal. 

Disclosure Platform:  The Disclosure Platform is a brand-new project created by the Dubai Courts to simplify the execution of court orders by giving all relevant authorities and officials access to data on the cash and assets of judgement debtors through a unified platform. 

The platform acts as a central hub for information on the assets and financial status of people and organizations who are the target of court judgements. It permits the existence and location of the assets and funds of judgement debtors to be disclosed to all relevant governmental bodies and officials, including banks, the police, immigration, and customs authorities. 

Sale Notification System: The Dubai Courts have launched a new programme called the Sale Notification System to speed up the process of selling property that has been seized in accordance with a court order.

Under this system officials responsible for the execution of a judgment will be notified about the assets that have been confiscated, and they will have a specific timeframe within which to sell these assets. This will ensure that the execution process is carried out efficiently and that the confiscated assets are put to their best possible use.

Smart Requests: The Smart Requests initiative seeks to enhance the efficiency of the Writ of Execution procedures by providing an online platform for the execution judge, execution officials, and the special execution commissioner authorized by the court to be notified about their enforcement responsibilities and tasks.

Integration with Ministry of Interior:  The Integration with Ministry of Interior initiative seeks to improve court judgement enforcement by working with the UAE Ministry of Interior. Through utilising the assistance of the police and security services, the programme aims to ensure that decisions are enforced properly.

Privatisation of Execution Procedures: By allowing private companies to conduct execution services, the Privatization of Execution Processes programme seeks to increase the effectiveness of enforcing court judgements. They are aligned with the procedures of Civil Law No. (42) of 2022, Dubai Courts will issue a decision to license private companies to provide judgment execution services.

The new efforts launched by the Dubai Courts under Taresh Eid Al Mansouri’s direction are intended to establish a modern judicial system in Dubai that exceeds international benchmarks for speed, efficiency, and service excellence.

The Director General underscored the Court’s dedication to ensuring that decisions are executed promptly, addressing issues that may limit service effectiveness, and implementing innovative procedures to enforce court orders.

These initiatives are anticipated to increase public, resident, and company confidence in the legal system and support Dubai’s competitiveness as a global metropolis.
