Applicability Of Arbitration Agreement

Concerning the Terms and Use of any ShortList Dubai product or service, all claims and disputes cannot be addressed informally or in small claims, the court shall resolve, under the terms of the arbitration agreement, by binding arbitration on an individual basis. Unless agreed differently.

This agreement applies to everyone, including you, ShortList Dubai, Our subsidiaries, affiliates, agents, employees, successors in interest, and assigns, as well as authorized and unauthorized users or beneficiaries of service or goods provided under the Terms.

Regarding the notification obligation and dispute resolution, any party may seek arbitration, both parties require to write the other with a written notice of disagreement that describes the nature and grounds of the claim or dispute, as well as the solution. Time limits

In case of pursuing arbitration either by you or ShortList Dubai, the action must be launched and/or held within the statute of limitations, and the action should be established within the deadline set by the AAA Rules for the applicable claim.

Authority of Arbitrator

In the process of arbitration, the concerned authority of the arbitration will determine your rights and ShortList Dubai’s liabilities; the dispute will not be composed of other matters or parties. The arbitrator has the authority to dismiss as well as grant motions for all or a part of any claim. The arbitrator has the right to authorize the award of monetary damages and non-monetary remedies as well as relieve the party under the law, the AA rules, and the Terms. The key facts and conclusion will be described in a written statement regarding the award. They also have the right to grant individual relief that a judge would have in a court of law. Once the decision is made, it is final for both parties.

Waiver of Jury Trial

While all the claims and disputes are resolved by ‌arbitration following this arbitration agreement, both parties involved hereby waive their constitutional rights and statutory rights to sue in court and have a trial before a magistrate or a jury.

This procedure is more efficient, time-limited, and cost-effective than court rules. If in case any litigation arises between you and ShortList Dubai in any state or federal court, regarding vacating or enforcing an arbitration award or otherwise. both parties require to waive all rights to a jury trial, to have a judge resolve the controversial issue.

Waiver of class or consolidated actions

All the claims and disputes within the arbitration agreement must be judged on an individual basis; claims from multiple customers or users are not valid. Hence, it cannot be arbitrated combined with those of other users.        

Confidentially

Arbitration processes are conducted in confidentiality. Both the parties involved settle to undergo the process confidentially unless the law demands it. However, this provision does not prevent any party from disclosing to the court of law any information regarding the agreement, such as a judgment or a solution.

Severability

If an arbitrary agreement or a piece of it is considered unlawful according to the law, then such agreements should be avoided and severed, while the rest of the agreement can continue (if a part of the bit violates).

Right to waive

The party who is alleged of the claimant may waive all of their rights and limitations specified in this agreement. In any case, it does not impact or waive any other rights or provisions of this agreement. 

Survival of Agreement

This arbitration agreement may benefit in surviving your relationship’s termination with ShortList Dubai

Small claims court

In addition to this agreement, either you or ShortList Dubai may file a claim in a small claims court as an individual. 

Emergency Equitable Relief

To hold on to the agreement, either party may seek emergency equitable fund relief from a state or federal court. A request for the same measure does not violate any right or bind anything under the terms of this agreement.

Claims Not Subject To Arbitration

Defamation, violation of computer fraud and abuse act, copyright, trademark, or trade secrets, and any other misappropriation of the other party’s patent are not subject to the conditions of this arbitration agreement.

Prior to the arbitration agreement, it authorizes parties to submit the agreements to the personal jurisdiction of the courts located in the county of the Netherlands, California, for such purposes.

The website may be under the U.S. export control laws as well as the export and import control laws of other nations. You must not agree to the export or import of any technical data acquired from ShortList Dubai U.S., that violates the export law of the United States.

You recognize that all the communications made by ShortList Dubai, in case of agreements, notices, disclosures, and conditions –electronically satisfy you. In case it doesn’t satisfy and requires the legal procedure, such communications would satisfy in writing.

Entire Terms

These terms highlight the agreement between you and us, allowing you to use our website. Failing to execute or enforce any of these rights in these terms does not indicate a waiver of all of the rights to these provisions. Some of the sections in these Terms are simply for convenience and have no legal significance in the statements.

In case of provisions of these Terms, they are determined to be ineffective and invalid; hence the invalid Term will be deemed changed to an enforceable to the maximum extent permissible by the law. Your relationship with ShortList Dubai is an independent contract.

You cannot terminate, transfer, or assign any of these terms without ShortList Dubai’s written agreement, and any attempted forgery to convey the same solution may violate the agreement and will be indicated as null and void. ShortList Dubai may assign these Terms effortlessly; the conditions in these Terms are applicable against assignees
